B.C. Supreme Court Justice John Gibb-Carsley issued an arrest warrant on May 6 for blogger Daryl Grant MacAskill, ordering him brought before the court over allegations he breached an injunction in a defamation suit filed by the family that owns and operates Sandher fruit packers.
The warrant follows an October ruling by Justice Ward Branch, who called MacAskill’s posts “hurtful and extreme” and ordered takedowns—orders the court says MacAskill ignored while also missing a court appearance.
Writing under the alias “Ace Ventura” on his Gangsterism Out site, MacAskill published sweeping, unproven claims about the Sandher Fruit Packers business. In his latest reasons, Justice Gibb-Carsley found the posts lacked factual support and amounted to misinformation, noting more than 400 abusive emails sent to counsel and concluding MacAskill deliberately avoided court. The judge agreed with the family’s request to issue a warrant so he can answer the contempt application.
MacAskill failed to appear in his own defense and referred to himself as ‘indigent’.
The ruling recounts prior incidents: MacAskill, who suffers from a variety of mental challenges, previously served 15 days for contempt after failing to pay damages awarded to Ralph van der Walle in 2022 for similar charges, and at one point was located at a homeless camp in Burnaby by a private investigator.
In this case, the court said a supposed “police report” MacAskill filed as evidence was fabricated, and rejected the rest of his material as inadmissible, dismissing his bid to toss the suit—then issued the arrest warrant.
MacAskill more recently has allegedly blackmailed companies to stop talking about them on his blog in return for figures as high as $10,000. He continues to post about the Sandher’s, and the judge in his case, and various lawyers on his blog.
He remains at large.
